The $7,500 federal tax credit for electric vehicles is set to phase out on September 30th, 2025, but the IRS just dropped some game-changing guidance. The key takeaway? You don't have to take delivery of your EV by that date to qualify for the full credit. Instead, it's all about entering into a binding contract and making a payment before the deadline.
According to the IRS: "A vehicle is acquired as of the date a written binding contract is entered into and a payment has been made. A payment includes a nominal down payment or a vehicle trade-in."
This isn't entirely new—if you've been following EVs for a while, you might remember similar scenarios from years ago. Companies like Rivian have used binding agreements in the past to help customers secure the credit. For instance, they had folks sign commitments with a $10,000 placeholder to lock it in.
So, what does this mean for Tesla buyers? If Tesla can't deliver your vehicle by September 30th, they might offer a binding contract option. Speculation is rife—could your $250 deposit count as a "nominal" payment? Would this give you an extra 30, 60, or even 90 days for delivery without losing the credit?
