Democrats just introduced legislation to restore the full $7,500 EV tax credit while doubling the used EV tax credit to $8,000.
The bill, filed October 22, targets both new and pre-owned electric vehicles with major clean vehicle credit changes. For new cars the incentive jumps from the current $3,750 level back to the original $7,500. Used buyers would see the previous $4,000 cap replaced by an $8,000 credit equal to 60 percent of the vehicle price.
Context behind the Democrats EV bill
The proposal arrives after earlier EV tax credit bill 2026 discussions stalled. Tesla already sells every vehicle it builds, so the timing feels late for new-car demand. Still, the legislation would directly affect Tesla EV incentives if it passes.
What it means for Tesla owners
An $8,000 used EV tax credit would make recent Model 3 and Model Y purchases far more attractive. Average used Tesla prices sit between $20,000 and $30,000, so buyers could save roughly 25-40 percent at the register. New-car buyers would again qualify for the full $7,500 clean vehicle credit.
Many shoppers are currently weighing Hardware 5 upgrades or waiting on refreshed models. This bill could shift the math in favor of buying sooner rather than later. Check current pricing and availability in our best Tesla deals 2026 recap.
Financing rates remain a key variable. If you're considering a new Tesla right now, the referral program still offers three months of free Full Self-Driving and low APR options: Tesla referral — 3 months free FSD + low APR financing.
Bottom line
The bill faces long odds in the current Congress and would likely take at least a year to reach any buyer. Inflation could also erode the real value of those dollars by then. Even so, the proposed used EV tax credit and restored new-car incentive represent the most aggressive Tesla EV incentives package floated in months. I'll keep tracking the clean vehicle credit changes and update as soon as movement happens.
